Full Self-Driving Software May Cause Crash
FSD Beta software that allows a vehicle to exceed speed limits or travel through intersections in an unlawful or unpredictable manner increases the risk of a crash.

Summary
Tesla, Inc. (Tesla) is recalling certain 2016-2023 Model S, Model X, 2017-2023 Model 3, and 2020-2023 Model Y vehicles equipped with Full Self-Driving Beta (FSD Beta) software or pending installation. The FSD Beta system may allow the vehicle to act unsafe around intersections, such as traveling straight through an intersection while in a turn-only lane, entering a stop sign-controlled intersection without coming to a complete stop, or proceeding into an intersection during a steady yellow traffic signal without due caution. In addition, the system may respond insufficiently to changes in posted speed limits or not adequately account for the driver’s adjustment of the vehicle’s speed to exceed posted speed limits.
Remedy
Tesla will release an over-the-air (OTA) software update, free of charge. Owner notification letters were mailed April 15, 2023. Owners may contact Tesla customer service at 1-877-798-3752. Tesla’s number for this recall is SB-23-00-001.

Update Vehicle Software to Improve Certain FSD Beta Driving Maneuvers
Condition
In certain rare circumstances and within the operating limitations of FSD Beta, when the feature is engaged, the
feature may potentially infringe upon local traffic laws or customs while executing certain driving maneuvers in certain
conditions before some drivers may intervene.
Correction
FSD Beta version 11.3.1 or newer improves how FSD Beta negotiates certain driving maneuvers in those conditions.
Inspect the vehicle software version and, if necessary, update to FSD Beta version 11.3.1 or newer.
Procedure
On the vehicle touchscreen, touch Controls (vehicle icon) > Software, and then scroll down to display the vehicle software version.
- If the software version displayed does not contain the text “FSD” or “fsd”, no further action is necessary. Use correction code S022300001.
- If the software version displayed contains the text “FSD Beta 11.3.1” or is of a newer version, no further action is necessary. Use correction code S022300001.
- If the software version displayed contains the text “FSD Beta 11.3” or is of an older version, update to FSD Beta 11.3.1 or newer (refer to Service Manual procedure 00020003; Legacy Model S, Legacy Model X, Model 3, Model Y, Palladium Model S, Palladium Model X ). Use correction code S032300001.

Description:
In accordance with a recent recall (campaign #23V085 for US and #2023-063 for Canada), Tesla is making improvements to the following specific behaviors within FSD Beta:
- Improved decision logic to proceed through or stop at certain yellow lights by modeling the decision as a tradeoff framework that considers estimated: deceleration required to stop, time to enter and exit the intersection, and the distance traversed across the intersection before the light transitions to red. This should make yellow light handling more natural and human-like.
- Improved the longitudinal slowdown control profile when leading up to stop sign intersections to make the overall maneuver feel more perceptible and natural.
- Improved the Tesla’s speed adjustment when entering certain speed zones by allowing for earlier control for detected speed limit signs. The assertiveness of the response when slowing down for detected speed limit signs is determined by the current speed and its difference to the speed indicated by the detected sign. Added a visual glow behind the speed limit icon on the user-interface to alert the driver when the vehicle’s set speed exceeds the detected speed limit by more than 50%. Finally, the option for an absolute Speed Limit offset in FSD Beta was removed; only the percent-based offset will be available.
- Updated the behavior for certain scenarios where the Tesla may maneuver from a turn lane to continue traveling straight. These maneuvers will now be treated as a lane change, where the turn indicator is used to alert other drivers of the Tesla’s intent.
As a reminder, the driver is responsible for vehicle operation even when FSD Beta is engaged. You must constantly supervise the road, keep your hands on the wheel and be ready to intervene to maintain safety.

Chronology :
– On January 25, 2023, as part of regular ongoing communications between Tesla and NHTSA relating to Autopilot and FSD Beta, NHTSA advised Tesla that it had identified potential concerns related to certain operational characteristics of FSD Beta in four specific roadway environments, as described above. NHTSA requested that Tesla address these concerns by filing a recall notice.
– In the following days, NHTSA and Tesla met numerous times to discuss the Agency’s concerns and Tesla’s proposed over-the-air (“OTA”) improvements in response.
– On February 7, 2023, while not concurring with the agency’s analysis, Tesla decided to administer a voluntary recall out of an abundance of caution.
– As of February 14, 2023, Tesla has identified 18 warranty claims, received between May 8, 2019, and September 12, 2022, that may be related to the conditions described above. Tesla is not aware of any injuries or deaths that may be related to such conditions.

On August 13, 2021, NHTSA’s Office of Defects Investigation (ODI) opened a Preliminary Evaluation (PE21-020) to assess the performance of Tesla’s Autopilot system (a system characterized by Tesla as an SAE Level 2 driving automation system designed to support and assist the driver in performing the driving task) available in Tesla vehicles. The investigation opening was motivated by an accumulation of crashes in which Tesla vehicles, operating with Autopilot engaged, struck stationary in-road or roadside first responder vehicles tending to pre-existing collision scenes. Upon opening the investigation, NHTSA indicated that the PE would also evaluate additional similar circumstance crashes of Tesla vehicles operating with Autopilot engaged, as well as assess the technologies and methods used to monitor, assist, and enforce the driver’s engagement with the dynamic driving task during Autopilot operation.
PE21-020 is upgraded to an Engineering Analysis (EA) to extend the existing crash analysis, evaluate additional data sets, perform vehicle evaluations, and to explore the degree to which Autopilot and associated Tesla systems may exacerbate human factors or behavioral safety risks by undermining the effectiveness of the driver’s supervision. In doing so, NHTSA plans to continue its assessment of vehicle control authority, driver engagement technologies, and related human factors considerations.

REASON FOR THIS RECALL
FSD Beta is an SAE Level 2 driver support feature that can provide steering and braking/acceleration support to the driver under certain operating limitations. When the feature is engaged, it could potentially infringe upon local traffic laws or customs while executing certain driving maneuvers in specific conditions, which could increase the risk of a collision if the driver does not intervene.
WHAT TESLA WILL DO
At no charge to you, Tesla will deploy an over-the-air (“OTA”) firmware update to affected vehicles that will improve how FSD Beta negotiates certain driving maneuvers in specific conditions.
WHAT YOU SHOULD DO
At this time, there is no action you need to take. The firmware remedy is not yet available. When the remedy is
available, it will be deployed OTA to your vehicle, and we will notify you.

Condition
In certain rare circumstances and within the operating limitations of FSD Beta, when the feature is engaged, the
feature may potentially infringe upon local traffic laws or customs while executing certain driving maneuvers in certain
conditions before some drivers may intervene.
Correction
FSD Beta version 11.3.1 or newer improves how FSD Beta negotiates certain driving maneuvers in those conditions.
Inspect the vehicle software version and, if necessary, update to FSD Beta version 11.3.1 or newer.

• If the software version displayed does not contain the text “FSD” or “fsd”, no further action is necessary. Use
correction code S022300001.
• If the software version displayed contains the text “FSD Beta 11.3.1” or is of a newer version, no further action
is necessary. Use correction code S022300001.
• If the software version displayed contains the text “FSD Beta 11.3” or is of an older version, update to FSD

With FSD Beta, as with all SAE Level 2 driver support features, the driver is responsible for operation of the vehicle whenever the feature is engaged and must constantly supervise the feature and intervene (e.g., steer, brake or accelerate) as needed to maintain safe operation of the vehicle. In certain rare circumstances and within the operating limitations of FSD Beta, when the feature is engaged, the feature could potentially infringe upon local traffic laws or customs while executing certain driving maneuvers in the following conditions before some drivers may intervene: 1) traveling or turning through certain intersections during a stale yellow traffic light; 2) the perceived duration of the vehicle’s static position at certain intersections with a stop sign, particularly when the intersection is clear of any other road users;
3) adjusting vehicle speed while traveling through certain variable speed zones, based on detected speed limit signage and/or the vehicle’s speed offset setting that is adjusted by the driver; and 4) negotiating a lane change out of certain turn-only lanes to continue traveling straight. NHTSA requested that Tesla address these concerns by filing a recall notice. – In the following days, NHTSA and Tesla met numerous times to discuss the Agency’s concerns and Tesla’s proposed over-the-air (“OTA”) improvements in response. Tesla is not aware of any injuries or deaths that may be related to such conditions.

Description of the Defect : FSD Beta is an SAE Level 2 driver support feature that can provide steering and braking/acceleration support to the driver under certain operating limitations. With FSD Beta, as with all SAE Level 2 driver support features, the driver is responsible for operation of the vehicle whenever the feature is engaged and must constantly supervise the feature and intervene (e.g., steer, brake or accelerate) as needed to maintain safe operation of the vehicle. In certain rare circumstances and within the operating limitations of FSD Beta, when the feature is engaged, the feature could potentially infringe upon local traffic laws or customs while executing certain driving maneuvers in the following conditions before some drivers may intervene: 1) traveling or turning through certain intersections during a stale yellow traffic light; 2) the perceived duration of the vehicle’s static position at certain intersections with a stop sign, particularly when the intersection is clear of any other road users;
3) adjusting vehicle speed while traveling through certain variable speed zones, based on detected speed limit signage and/or the vehicle’s speed offset setting that is adjusted by the driver; and 4) negotiating a lane change out of certain turn-only lanes to continue traveling straight. Description of the Safety Risk : In the specific and rare circumstances described above when a Tesla vehicle is operating with a software version of FSD Beta as described below and with FSD Beta engaged, certain driving maneuvers could potentially infringe upon local traffic laws or customs, which could increase the risk of a collision if the driver does not intervene.

that can Occur : As part of FSD Beta’s general design, the feature provides visual and audible warnings in certain circumstances to alert the driver to their constant supervisory responsibility, which customers acknowledge and agree to prior to first using FSD Beta. Independent of any warnings from FSD Beta, the driver’s observations of the vehicle’s operations and environmental surroundings may also indicate that intervention is necessary. – On January 25, 2023, as part of regular ongoing communications between Tesla and NHTSA relating to Autopilot and FSD Beta, NHTSA advised Tesla that it had identified potential concerns related to certain operational characteristics of FSD Beta in four specific roadway environments, as described above. NHTSA requested that Tesla address these concerns by filing a recall notice. – In the following days, NHTSA and Tesla met numerous times to discuss the Agency’s concerns and Tesla’s proposed over-the-air (“OTA”) improvements in response. – On February 7, 2023, while not concurring with the agency’s analysis, Tesla decided to administer a voluntary recall out of an abundance of caution. – As of February 14, 2023, Tesla has identified 18 warranty claims, received between May 8, 2019, and September 12, 2022, that may be related to the conditions described above. Tesla is not aware of any injuries or deaths that may be related to such conditions.
Description of Remedy :
Description of Remedy Program : Tesla will deploy an over-the-air (“OTA”) software update at no cost to the
customer. The OTA update, which we expect to deploy in the coming weeks, will improve how FSD Beta negotiates certain driving maneuvers during the conditions described above. How Remedy Component Differs from Recalled Component : Identify How/When Recall Condition was Corrected in Production :
Tesla does not plan to include a statement in the Part 577 owner notification about pre-notice reimbursement because there are no out of warranty repairs related to these conditions.
