Summary
Tesla, Inc. (Tesla) is recalling certain 2021-2023 Model S and X vehicles. The cabin doors can be unlocked during a crash. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 214, “Side Impact Protection.”
Remedy
Tesla has released an over-the-air (OTA) software update, free of charge. Owner notification letters are expected to be mailed February 17, 2024. Owners may contact Tesla customer service at 1-877-798-3752. Tesla’s number for this recall is SB-23-00-009.

Chronology :
– On December 6, 2023, during routine validation side-impact testing, Tesla Engineering observed a cabin door unlatch after impact on the non-struck side.
– On December 7, 2023, Tesla Engineering identified that the test vehicle was operating without the lockout functionality that complies with FMVSS No. 214, S9.2.3(b)(1). Tesla Engineering further identified that the lockout functionality was inadvertently excluded from the affected vehicles with software release 2021.36 and later releases (up to release 2023.44.30, which contains the recall remedy). Software release 2021.36 began deploying to the affected vehicles on September 30, 2021.
– On December 13, 2023, a non-compliance with FMVSS No. 214, S9.2.3(b)(1) was verified and a voluntary recall determination was made on the same day.
– As of December 14, 2023, Tesla is not aware of any warranty claims or injuries relating to this condition.

Description of Remedy Program : At no cost to customers, affected vehicles received an over-the-air
software remedy, which began deploying on or shortly after December 12, 2023, with software release 2023.44.30. Software release 2023.44.30 or later releases incorporate the lockout functionality that complies with FMVSS No. 214, S9.2.3(b)(1). No service visit is necessary, and no further action is necessary from owners whose vehicles are equipped with software release 2023.44.30 or a later software release. How Remedy Component Differs from Recalled Component : Identify How/When Recall Condition was Corrected in Production : Tesla does not plan to include a statement in the Part 577 owner notification about pre-notice reimbursement to owners because there is no paid repair relating to the underlying condition and owners received the remedy free of charge with an OTA software release.
On affected vehicles, software release 2023.44.30 or a later release complies with FMVSS No. 214, S9.2.3(b)(1), whereas prior software releases back to release 2021.36 do not.
Beginning on December 9, 2023, software release 2023.38.200.2 was introduced in production, which incorporates the lockout functionality that complies with FMVSS No. 214, S9.2.3(b)(1).
